National and International Privacy Policy for PollenPak

This National and International Privacy Policy supplements the main PollenPak.com Privacy Policy. It applies specifically to visitors, members, and affiliates who access PollenPak.com from outside the United States, or whose personal information may be subject to the data protection laws of another country or region.

If you are located in the United States, the main PollenPak.com Privacy Policy governs how we handle your information. If you are located outside the United States, this policy applies in addition to, and alongside, that main Privacy Policy. Where any conflict exists between this policy and the main Privacy Policy regarding an international visitor, the provisions that grant you stronger protection will apply.

By using PollenPak.com from outside the United States, you acknowledge that your information will be transferred to, processed, and stored in the United States, as described below.

Who We Are

PollenPak.com is operated from the United States and provides family-friendly entertainment content, character storytelling, memberships, affiliate opportunities, merchandise, and related services associated with Treasures of the Golden Bee. For purposes of this policy, “Pollen Pak,” “PollenPak.com,” “we,” “us,” and “our” refer to the same business operations described in our main Privacy Policy.

Why This Policy Exists

Pollen Pak is a family entertainment brand, and our content may appeal to visitors, parents, and children located anywhere in the world. Several countries and regions, including the European Union, the United Kingdom, Canada, Brazil, and Australia, have data protection laws that may apply to us even though we are based in the United States, particularly where children’s personal information is involved. This policy explains those obligations clearly and tells you what rights you have if you are covered by them.

European Union and European Economic Area: GDPR

The General Data Protection Regulation (GDPR) may apply to PollenPak.com if you are located in the European Union or European Economic Area, even though we do not have a physical presence there, because we offer services that may be accessed by EU residents and because we may use cookies, analytics, and advertising technologies that track behavior of visitors located in the EU.

International data transfers. Because PollenPak.com is operated from the United States, your personal information will be transferred outside the European Economic Area when you use our website. Where required, we rely on appropriate safeguards for these transfers, such as Standard Contractual Clauses approved by the European Commission, and we require our service providers to maintain comparable protections for your information.

Children’s consent under GDPR. Under GDPR Article 8, where consent is the legal basis for processing a child’s personal information in connection with an online service offered directly to a child, that consent is only valid if the child is at least 16 years old, or if the child is younger, where consent has been given or authorized by a parent or legal guardian. Some EU member states set this threshold as low as 13. PollenPak.com is designed for use by adults, and our membership, affiliate, and email signup processes are intended to be completed by a parent, guardian, or other adult on behalf of their family, not directly by a child.

United Kingdom: UK GDPR, the Data Protection Act 2018, and the Children’s Code

If you are located in the United Kingdom, the UK GDPR and the Data Protection Act 2018 apply to our processing of your personal information in substantially the same way as the EU GDPR described above, including your right to access, correct, erase, restrict, and port your personal information, and your right to complain to the UK Information Commissioner’s Office (ICO).

The Children’s Code. The UK’s Age Appropriate Design Code, commonly called the Children’s Code, applies to online services that are likely to be accessed by children under the age of 18 in the United Kingdom, regardless of whether the service is based in the UK and regardless of whether children are the intended audience. Because Pollen Pak is a family entertainment brand whose characters and stories may appeal to children, we take the following steps consistent with the Children’s Code:

We do not knowingly enable profiling of child visitors for advertising or content personalization purposes.

We do not switch on geolocation tracking by default for any visitor, and we do not knowingly enable it for children.

We design our membership, affiliate, checkout, and email signup processes to be completed by an adult, and we do not use design techniques, sometimes called nudge techniques, intended to encourage children to weaken their privacy settings or share unnecessary personal information.

We collect and retain only the personal information reasonably necessary to operate PollenPak.com and do not knowingly share children’s personal information beyond what is described in our main Privacy Policy.

We will take additional steps consistent with the Children’s Code if PollenPak.com later introduces interactive features, accounts, or community tools that children could use directly.

Canada: PIPEDA and Quebec’s Law 25

Brazil: LGPD

If you are located in Brazil, the Lei Geral de Proteção de Dados Pessoais (LGPD) may apply to our processing of your personal information. Under the LGPD, you generally have rights to confirmation of processing, access, correction, anonymization, deletion, portability, and information about the sharing of your personal information with third parties. Australia: Privacy Act 1988

If you are located in Australia, the Privacy Act 1988 (Cth) and the Australian Privacy Principles may apply to our processing of your personal information. How We Handle International Data Transfers Generally

Regardless of where you are located, when you use PollenPak.com your personal information will typically be transferred to, stored, and processed in the United States, where our website, email platform, affiliate tracking systems, and payment processors operate. By using PollenPak.com, you understand and accept that your personal information will be processed in the United States, which may have different data protection laws than your home country. Where applicable law requires additional safeguards for these transfers, we implement appropriate measures, such as Standard Contractual Clauses, to protect your personal information consistent with this policy.

Age Verification and Family-Friendly Content Outside the United States

PollenPak.com markets family-friendly entertainment content that may be appealing to children in any country. Regardless of your location, PollenPak.com is designed to be used by adults, parents, and legal guardians for purposes such as joining the Golden Hive membership, applying to the affiliate program, subscribing to email updates, and making purchases. We do not knowingly direct any data collection feature at children directly, anywhere in the world, and we rely on parents and guardians to supervise how children in their household interact with our content.
